Contract — Formation — Agreement to lease — In agreement, plaintiff agreed to lease a shop to defendant for a specified term at a stated rental — Agreement also stated that lessee would enter into a formal lease in the form usually adopted by the lessor's solicitors and the lease was to be approved by the lessee's solicitors — Defendant gave plaintiff a cheque for $3000 — Defendant later decided not to continue with the transaction and stopped payment on the cheque — Whether a binding contract had been concluded — Whether defendant should be granted leave to defend the bill writ issued by the plaintiff — Code of Civil Procedure, RR 490 and 495.
