Practice and procedure — Jurisdiction — Foreign company served out of jurisdiction — Plaintiff sued six defendants, five of whom were served in New Zealand and the sixth of whom was served without leave overseas — Sixth defendant applied to dismiss proceeding against it on the ground that the Court had no jurisdiction — Whether sixth defendant was a proper party to the proceeding — Whether Court could decline jurisdiction on the basis that no cause of action was disclosed against sixth defendant — Judicature Act 1908, s 16 - High Court Rules, RR 131 and 219.
