Criminal law — Practice and procedure — Delay in bringing accused before a Court — Accused was arrested at 9 am on minor cannabis charge and was detained for questioning about armed robbery — Accused was charged with armed robbery about 9 pm and was brought before Court on both charges at noon on following day — Whether accused should have been brought before Court at soonest possible time — Whether detention of accused was unlawful — Whether voluntary confession made by accused during period of detention was admissible — Crimes Act 1961, s 316(5).
