Criminal law — Practice and procedure — Trial — Accused elected trial by jury and was committed for trial in the District Court — The proceedings were transferred to the High Court where trial before a Judge alone was ordered — Accused was convicted on two counts but the Court of Appeal ordered a new trial on these — Whether retrial must be in High Court — Whether accused had a right to trial by jury — Whether Court should exercise its inherent jurisdiction to set aside order that trial take place before High Court Judge alone — District Courts Act 1947, s 28J — Crimes Act 1961, ss 361A, 361B and 361C.
