Criminal law — Parties to offences — Murder — Crown advanced case against accused that he was a party to the offence under both s 661(1) and s 66(2) of the Crimes Act — Judge indicated to jury that there was no evidence of a common intention to prosecute an unlawful purpose under s 66(2) but he left the issue to the jury — Whether, having indicted that there was no evidence under s 66(2), the Judge should have left that issue to the jury — Crimes Act 1961, s 66.
