Criminal law — Indictment — Second accusation — Three accused had been tried on charges of being members of a riotous assembly — One had been convicted and the other two acquitted — Crown later charged the three accused with being members of a riotous and tumultuous assembly who unlawfully damaged property — Whether accused should be discharged — Crimes Act 1961, s 359.
