Contract — Breach — Sale of shares — Purchaser defaulted on contract to buy shares and vendor sued for damages — Purchaser claimed that at date of settlement the vendor did not own the shares and had not suffered loss — Whether, if vendor was in position to transfer the shares at date for settlement, he was entitled to damages.
Damages — Assessment — Breach of contract for sales of shares — Purchaser defaulted in contract to purchase shares — Whether measure of vendor's damages was the agreed purchase price of the shares less their market value at date for settlement.
