Fair Trading Act — Misleading or deceptive conduct — Savings accounts with similar names — Auckland bank had operated a HIT savings account in the Auckland area for some years as had trustee savings bank in other areas of New Zealand — Trustee bank in Auckland and advertised its HIT account — Auckland bank sought injunction — Whether public would be misled about with whom they were dealing when there were two HIT accounts — Whether interim injunction should be granted — Whether balance of convenience favoured Auckland bank as substantive trial was some 12 months away — Fair Trading Act 1986, s 9.
