Contract — Cancellation — Misrepresentation — Purchaser of business cancelled contract because of fraudulent misrepresentations by vendor — Contract contained clauses that the vendor made no warranty, that the purchaser purchased in reliance on his own judgment and not upon any representation or warranty, and that any error or misdescription would not annul the sale — Whether clauses in contract precluded Court from inquiring into existence of misrepresentation and reliance thereon — Whether clause concerning any error or misdescription overrode statutory remedies — Contractual Remedies Act 1979, ss 4, 5 and 7.
