Industrial law — Jurisdiction — Stay of proceedings — Union placed handling ban on contractors and subcontractors of building supply company in relation to products and equipment of that company — Company sued for damages and union sought stay of proceedings on the basis that only the Labour Court had jurisdiction — Whether the High Court had jurisdiction to determine whether the actions of the union were a strike — Whether the Labour Court had similar jurisdiction and should determine the issues — Whether proceedings should be stayed — Labour Relations Act 1987, ss 231, 242 and 279.
