Criminal law — Offences — Homicide — Accused were found guilty of murder — Evidence was that accused wound sheet around neck of deceased causing his death by strangulation — Accused claimed they intended only to stop deceased calling for help — Whether the unlawful object of stopping deceased from calling for help was separate from the act which caused his death — Whether Judge had misdirected jury as to the difference between an assault and an assault intended to cause injury — Crimes Act 1961, s 167(d).
