Testamentary promises — Family protection — Mother died intestate in Australia six months after she had married a domiciled Australian — Although mother had been living in Australia, her assets remained in New Zealand — Her only son brought a testamentary promises action against the estate claiming that his mother had promised to leave him her entire estate — Son also sought provision under the Family Protection Act 1955 - Whether, if mother had become domiciled in Australia, a New Zealand Court had jurisdiction to make an award under the Law Reform (Testamentary Promises) Act and/or the Family Protection Act — Quantum of award — Law Reform (Testamentary Promises) Act 1949, s 3.
