Trade marks and trade names — Infringement — Comparative advertising — Wine maker advertised a bottle of its wine together with a bottle of a competitor's wine — Illustration of competitor's bottle showed competitor's trade marks and clearly identified the wine as that of the competitor — Advertisement praised the two wines and suggested they were of equal quality — Competitor's trade marks were registered in Part B of the register — Whether the advertisements infringed competitor's trade marks — Whether competitor should be granted an interim injunction — Trade Marks Act 1953, ss 2, 8(1)(b) and 9(2).
